Terms and Conditions for the Microsoft Trade-In Promotion (Promotion)

  1. By entering the Promotion, Participants agree to be bound by these terms and conditions (Promotion Terms). Promotional materials relating to the Promotion, including all information on how to enter the Promotion, also form part of these Promotion Terms. In the event of any conflict between any terms referred to in such promotional materials and these Promotion Terms, these Promotion Terms shall take precedence.

  2. This Promotion is open to individuals over the age of 18, resident in the United Kingdom who hold a valid UK bank account (Participant). This Promotion is not open to employees of Microsoft, Opia Limited, or manufacturers of Qualifying Products (as defined in Table 1 below), and their immediate families, or their subsidiaries, divisions, affiliates or anyone professionally connected with the Promotion. Participants are permitted to make a maximum of two (2) Claims (as defined in Condition 7 below) and send in two (2) separate Trade-In Devices (as defined in Table 2 below) in respect of two (2) separate Qualifying Products (as defined in Table 1 below) pre-ordered and purchased through either the Online Store or the Physical Store only.

  3. The Promotion is available at both the online Microsoft Store available at: https://www.microsoft.com/en-gb/store/b/home (Online Store), or in-store at the Microsoft Regent Street Flagship Store, 253-259 Regent Street, London, England W1B 2ER (Physical Store) (together the Participating Retailer). Entry to the Promotion shall differ (in accordance with these Promotion Terms) depending on whether the pre-order and subsequent purchase of the Qualifying Product takes place at the Online Store or the Physical Store.

  4. This Promotion shall operate between the 2nd October 2019 (00:01 – BST) and the 22nd October 2019 (23:59 – BST) (Pre-Order Period).

Entry to the Promotion via the Online Store

  1. To enter the Promotion via the Online Store, Participants must:

5.1 pre-order a new (i.e. not second hand or refurbished) Qualifying Product (as shown at Table 1 below) via the Online Store within the Pre-Order Period;

5.2 subject to compliance with Condition 5.1 above and Condition 5.4 below, and the Participant paying in full for the Qualifying Product (payment will be taken using the debit/credit card details provided upon pre-order when the Qualifying Product is released and shipped to the Participant's delivery address provided upon pre-order), the Participant will be eligible to claim a variable cashback reward (Reward) as shown at Table 2 below upon trading in a qualifying device (Trade-In Device) as defined in Condition 9 below;

5.3 Participants must then visit https://tradeuptosurface.com/tradein and provide the requested information including a valid proof of purchase (including pre-order confirmation and shipment confirmation for the Qualifying Product) in order to register their Qualifying Product and make an application for a Reward (Online Claim). Online Claims must be submitted within thirty (30) days of the date on which the Qualifying Product is delivered as stated on the relevant delivery tracking confirmation and in any case no later than 23:59 (GMT) on the 27th December 2019 (Online Claim Period). For the avoidance of doubt the date of delivery stated on the applicable tracking information shall be considered day one (1), Online Claims made outside of the Online Claim Period shall be considered invalid and ineligible for a Reward; and

5.4 if a Participant cancels their pre-order of the Qualifying Product or returns the Qualifying Product at any time, they will no longer be eligible to enter the Promotion and receive a Reward.

Entry to the Promotion via the Physical Store

  1. To enter the Promotion via the Physical Store, Participants must:

6.1 pre-order a new (i.e. not second hand or refurbished) Qualifying Product (as shown at Table 1 below) via the Physical Store during the Pre-Order Period. To pre-order the Qualifying Product via the Physical Store, Participants must speak to an in-store associate who will then collect the Participant's name and email address in order to register the pre-order. Upon registration of the pre-order, the Participant will then receive a pre-order confirmation email (Pre-Order Confirmation);

6.2 collect and pay (in full) for the Qualifying Product at the Physical Store within 5 days of the official general availability date of the relevant Qualifying Product (Collection Period). In order to collect the Qualifying Product, Participants must show their Pre-Order Confirmation to an in-store associate and make full payment for their pre-ordered Qualifying Product. The in-store associate at the Physical Store will then provide a validation card (Validation Card) to the Participant. At this point, the Participant will be eligible to claim a Reward as shown in Table 2 below upon trading in a qualifying Trade-In Device as set out at Table 2 below;

6.3 Participants must then visit https://tradeuptosurface.com/tradein within 30 days from the date on which they collect and pay for the Qualifying Product in accordance with Condition 6.2 above (and in any event no later than 27th December 2019) and provide the information requested including the details contained in their Validation Card and proof of purchase of the relevant Qualifying Product in order to register their Qualifying Product and make an application for Claim (Physical Claim). For the avoidance of doubt the date of collection where full payment for the Qualifying Product is made shall be considered day one (1);

6.4 if a Participant cancels their pre-order of the Qualifying Product or returns the Qualifying Product at any time, they will no longer be eligible to enter the Promotion and receive a Reward; and

6.5 if the Participant fails to collect and pay for the Qualifying Product in full within the Collection Period, the Qualifying Product will be placed back into general inventory and the Participant will no longer be eligible to enter the Promotion or make any associated Claim for Reward.

Terms and Conditions applicable to both Online Store Participants and Physical Store Participants

  1. Both the Online Claim and the Physical Claim will together be referred to in these Promotion Terms as the Claim.

  1. Qualifying Products are subject to Participating Retailer availability and a maximum of 2875 Qualifying Products are available as part of this Promotion.

  2. For a submitted device to be considered a Trade-In Device it must both be a device listed in Table 2 below and meet the Acceptance Criteria (also defined within Table 2).

  1. Upon purchasing a Qualifying Product in accordance with the requirements of Condition 5 above in respect of the Online Store, or in accordance with the requirements of Condition 6 above in respect of the Physical Store, and subsequently submitting an eligible Trade-In Device (as described in Table 2 above) and presuming full compliance with the Promotion Terms, Participants shall be eligible to receive a Reward dependant on the submitted Trade-In Device as reflected in Table 2 above.

  2. The Promoter accepts no responsibility for Claims not successfully completed due to a technical fault technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind. Subject to Condition 14 below, a Claim must be fully completed to be eligible for Reward and if a Participant fails to provide all required information as part of their Claim, their Claim will be rejected.

  3. Upon submission and approval of the Claim, Participants will receive an email within 2 working days of Claim submission confirming approval (Claim Approval) and providing instructions on how to ship their Trade-In Device. Participants must ship their Trade-In Device as instructed within 15 calendar days of the date of Claim Approval.

  4. Participants shall receive a pre-paid label or postage contribution. Where a postage contribution is provided it shall be paid together with the Reward in accordance with Condition 15. For the avoidance of doubt postage contribution shall not be paid to or against non-valid Claims. Where a postage contribution is made it shall be made at the rate of £10.00 for the initial Trade-In Device, then £5.00 per Trade-In Device subsequently sent in by the Participant as part of the Promotion.

  5. If an incomplete Claim form or a non-valid proof of purchase, pre-order or collection is submitted by the Participant a notification email will be sent providing the opportunity for the Participant to submit the required items within 5 working days of the email being sent. If no reply is received within said timeframe then the Claim will be deemed invalid and rejected and the Participant shall not be eligible to receive any Reward.

  6. Upon the Trade-In Device being received by the Promoter, the Participant shall receive an email confirmation of payment of the relevant Reward via bank transfer to the bank account nominated during the Claim process. Such payment will be made within 14 calendar days of receipt of validation of the Trade-In Device.

  7. Each Reward is as stated and is non-exchangeable and non-transferable. There is no alternative to the Reward in whole or in part. By participating in the Promotion, Participants agree that each Reward is awarded on an "as is" basis, and that neither the Promoter nor any of its subsidiary or affiliated companies, make any representations or warranties of any nature with respect to each Reward awarded are is as stated and are non-exchangeable, non-transferable and no alternative is offered.

  8. Should the Trade-In Device fail to meet the Acceptance Criteria, the Trade-In Device will be returned or recycled free of charge to the Participant. The Participant shall be emailed and given seven (7) calendar days from the date of such email to choose the preferable option, if no response is received in this time frame then the Trade-In Device shall be recycled free of charge.

  9. The Promoter accepts no responsibility for lost or confidential data. Upon receipt of the Tradein Device all data will be destroyed. The Promotor is unable to retrieve any data once destroyed. Deletion of all confidential data and information, which is subject to applicable data protection legislation, is the sole responsibility of the Participant.

  10. The Promoter cannot accept liability for any Trade-in Devices that are lost, damaged or destroyed in transit. When available it is recommended that you the Participant utilises an insured postal service. The Promoter is unable to accept delivery by hand.

  11. Claims must only be submitted by the Participant. In no circumstances will Claims submitted by any third party on behalf of the Participant be accepted. Any such Claims will be rejected, and the Participant shall not be permitted to submit any further Claims.

  12. The Promoter reserves the right, at its absolute discretion, to disqualify Claims that it considers do not comply with these Promotion Terms.

  13. The Promoter shall have the right to undertake all such action as is necessary to protect itself against fraudulent or invalid Claims including, without limitation, to require further verification from a Participant of proof of pre-order, purchase or collection, as well as the identity and other relevant details of a Participant.

  14. If a Participant cancels their pre-order of the Qualifying Product or returns the Qualifying Product after submitting a Claim, the Claim will be deemed invalid and cancelled. Participating Retailer reserves the right to monitor returns of the Participant's purchases Qualifying Product purchased at the relevant Participating Retailer.

  15. The Promoter reserves the right to modify, cancel, terminate or suspend the Promotion in whole or in part, at its sole discretion, if it believes the Promotion is not capable of being conducted as specified within these Promotion Terms or in the event of a virus, a computer bug or unauthorised human intervention or any other cause that is beyond the reasonable control of the Promoter that could corrupt or affect the administration, security, impartiality or normal course of the Promotion.

  16. Save where it has been negligent, the Promoter will not be responsible for any damage, loss or injury resulting from Participants' entry into the Promotion or their acceptance and/or use of a Reward, or for technical, hardware or software failures, lost, faulty or unavailable network connections or difficulties of any kind that may limit or prohibit their ability to participate in the Promotion. The Promoter will not be responsible for any lost, damaged, defaced, incomplete, illegible or otherwise unreadable Claims. Proof of posting is not proof of receipt by the Promoter of any entries. Nothing in these Promotion Terms shall in any way limit the Promoter's liability for death or personal injury caused by its negligence or for any other matter where liability may not as a matter of law be limited.

  18. All the Promoter's decisions in relation to the Promotion are final and the Promoter will not enter into any correspondence with Participants.

  19. The Promoter: Microsoft UK, Microsoft Campus, Thames Valley Park, Reading, RG6 1WG (please do not send any Claim, Trade-In Devices or promotion related correspondence to this address as it will not be processed).

  20. This Promotion shall be governed by the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to hear any dispute or claim arising in association with the Promotion or these Promotion Terms.
